Thoroughbreds – Jockey Clint Harvey – Inquiry into report of IAC appointed Investigator

RWWA Stewards today concluded the inquiry into the report of IAC appointed Investigator Mr Peter Lavender into why the sample purported to have been provided by Jockey Mr Clint Harvey on 5 November 2012, was found by DNA analysis conducted by the Victorian Institute of Forensic Medicine (VIFM) to be from a female donor, including whether Mr Harvey was involved in substituting the sample.

Mr Harvey had previously been found guilty under AR175 (a) for an improper action in connection with racing, in that on 5 November 2012 at the Lark Hill training complex, after being requested by RWWA’s Principal Investigator, Mr P O’Reilly to provide a sample of his urine, he provided a sample which upon analysis was found to originate not from him but from a female donor.

In determining the charge against him the Stewards were satisfied that there had been no error in relation to the chain of custody of the sample once delivered by Mr Harvey and that the sample so provided was not from him.

On Thursday 13 November 2014, the inquiry was resumed in order to hear submissions on the question of penalty from Mr Harvey and his legal representative, Mr David Grace QC. The Stewards have now completed their deliberations and in imposing penalty, the following factors were taken into account by the Stewards;

 The seriousness of the offence

 The circumstances surrounding the commission of the offence

 Mr Harvey’s personal circumstances

 The deterrent value, both general and specific

 The stand down period, previously served by Mr Harvey

Mr Harvey was subsequently disqualified for a period of 12 months effective immediately.
